Shark Tank investor Kevin O'Leary, the founder of O'Leary Financial Group, has been part of the ABC reality TV series for many seasons. O'Leary and Frank McCourt were to initiate a $70 billion data center project.
As per the New York Post's March 2024 article, Kevin, the Shark Tank investor, appeared on FOX News to talk about why he could possibly face hurdles in raising money for the $3 billion data center. This happened after it was revealed that Trump's assets could potentially be seized. According to O'Leary, his concerns regarding this matter made him hesitant to invest in New York, which was also damaging "the American brand." He said:
"The collateral damage to the American brand is horrific. The No. 1 question I have when I go to these countries to try and raise this capital is: ‘What the hell is going on in New York’?And I tell them: 'It’s not America. It is just an anomaly. I swear to you, everybody, this is not America.'”

Reflecting on the economy of America and the possibility of Trump's assets being seized, as claimed by Attorney General Letitia James, O'Lear talked about the impact of a $454 million lawsuit.
He said that “the essence of what makes the American brand the No. 1 economy on Earth" was linked to property rights. The Shark Tank investor shared his opinion regarding the property rights mentioned "37 times in the constitution."
He explained that the situation was not about Trump but the constitutions. O'Leary continued:
“Property rights are mentioned 37 times in the Constitution. Due process, very important. Why steal someone’s assets in 27 days? Why not give them more time to come up with the cash? Forget about Donald Trump. Who would want this to happen to them?”
The seizure of Trump's assets affected O'Leary raising capital for the $s billion data center and would cause difficulty in the future. It was revealed that Trump's assets could be seized if he failed to provide a bond as his lawyers faced problems securing a bond on an urgent basis even after reaching out to multiple banks.
The Shark Tank investor further clarified that his criticism of James stemmed from his concerns regarding her targeting other politicians. O'Leary stated he was reluctant and careful to invest in New York state due to this potential seizure.
"I don’t know who she is. But all I could say was, who’s next?”

In an interview clip with News Nation posted to his official Instagram account on January 24, 2025, Kevin shared his plans related to the data center. He said:
"So, Frank McCourt and I announced that $70 billion project. We're gonna do it up in Grand Prairie, Alberta. The largest data center on Earth at the lowest cost of energy. I think we're not gonna have a hard time getting tenants at all."
