Backstreet Boys' vocalist, Nick Carter, has been hit with a lawsuit by Laura Penly who accused the singer of s*xually assaulting her. Penly alleged that as a result of the assault, she suffered STD and that eventually led to cervical cancer. In her lawsuit, she claimed to be 19 when the alleged assault took place in 2004.
Penly said Carter was unbothered for her well-being and now seeks more than $15,000 in damages along with a jury trial. According to People Magazine, Penly said she and Nick Carter had a physical relationship between December 2004 and February 2005, meeting frequently when she was in Los Angeles.
She stated that the encounters were consensual at first. However, she claimed the dynamics changed during a visit to his Hollywood apartment. Although she said she asked him to use protection, she alleged he refused and told her he didn’t have an STD.
Penly claimed that Nick Carter gave her multiple STDs, including HPV, which is known to cause serious health problems like cervical cancer. She reportedly tested positive for cancerous cells, and STIs like gonorrhea and chlamydia in 2005.
She was also diagnosed with Stage 2 Cervical Cancer and had to go through several treatments. These experiences led to significant emotional pain, physical suffering, medical complications, and problems with intimacy. This wasn’t the first time that Carter faced these accusations. Previously, three women had claimed that they were assaulted by the singer.
What did Penly and Nick Carter’s lawyers say about the lawsuit?
In a statement to the outlet, Gianna N. Elliot, a lawyer from Marsh Law Firm representing Penly, said it took a lot of bravery for survivors of s*xual assault to speak out, especially in the music industry.
She stated that Nick Carter used his fame and influence to harm several young women and avoid consequences. According to Elliot, the goal of this lawsuit was to break that cycle. She also shared hope that Laura Penly would receive the justice she deserved. Meanwhile, Carter’s attorneys said:
"This is just more of the same nonsense from the gang of conspirators and their lawyers who continue to abuse the justice system to try to ruin Nick Carter. It’s drawn from the same predictable playbook – lie in wait for decades until Mr. Carter is celebrating a professional milestone, then hide behind litigation privilege to make utterly false claims in an attempt to inflict maximum damage on Nick and his family."
According to the attorneys, Nick Carter did not recall ever meeting Laura Penly and denied having any romantic or physical relationship with her. They added that he intended to challenge the claims in court.
Penly stated that she and Carter had a consensual relationship on about three occasions. However, during one meeting, when she told him she only wanted to watch a movie, things went off-limits. She claimed Carter disregarded her refusal and insisted that the only reason she was there was for a physical moment.
According to the lawsuit, he then allegedly lifted her off the floor, threw her onto his bed, and r*ped her while ignoring her repeated objections. The complaint also said he didn’t use protection.
