Kay Flock’s Trial and Conviction
On December 16, 2021, police arrested Kay Flock for a shooting in Harlem. They said he killed a man named Hwascar Hernandez outside a barbershop.
Hernandez was shot in the back and neck. Since then, he has been in jail, waiting for his trial. On March 21, 2025 a jury in New York gave their verdict. As per the the United States Attorney's Office for the Southern District of New York, the jury found Kay Flock guilty of:
- RICO (racketeering conspiracy)
- Possession of a firearm resulting in death
- Assault with a dangerous weapon in aid of racketeering
- Attempted murder
- Use of firearm in attempted murder
- Assault with a dangerous weapon
But the jury believed that he did not kill Hernandez as part of gang activity, specifically, racketeering. This was the most serious charge he faced, and beating it may have saved him from a life sentence.
Prosecutors said Flock was a key member of the Sev Side/DOA gang. They claimed he was involved in multiple shootings and gang-related crimes from 2020 to 2022. They even used his song lyrics and music videos as evidence.
His lawyers argued against this. They said rap music is just art, and lyrics should not be used as proof of a crime. They claimed he was unfairly targeted. But despite this, the jury still convicted him on most charges.
