Deep River potato chips, a product of Old Lyme Gourmet company, faced a class-action lawsuit. The lawsuit was filed by Jewel Rankin and others, who alleged that the company used the "Non-GMO ingredients" labels on some chips sold under the Deep River brand.

Although a final decision regarding the lawsuit has yet to be made, customers who purchased the potato chips carrying the "Non-GMO ingredients" label between February 2, 2017, and December 6, 2024, are now eligible for compensation. These customers are classified within the "Settlement Class Member" category across the US for domestic consumption.

To receive monetary benefits as a part of the lawsuit’s settlement, the members must submit the claim form within the stipulated deadline, i.e., July 28, 2025. The claim form can be downloaded from the lawsuit settlement’s website, potatochipssettlement.com.

It must be noted that Settlement Class Members who submit valid claims with proof of purchase can receive $5.00 for the first product and $0.50 for each additional product.

There is no limit on the number of products if proof is provided for each. For valid claims without proof of purchase, members are eligible for $5.00 for the first product and $0.50 for up to 10 additional products.

The "Non-GMO ingredients" label led customers to believe that the potato chips were attested by a third party like the Non-GMO project. This label indicates that the product was made without genetically modified ingredients.

However, the complainants alleged this was not the case as the product was not certified by any third party. Old Lyme Gourmet company has dismissed the allegations made by Rankin and others.


Is there any non-monetary benefit from the lawsuit against Deep River potato chips?

Besides the monetary benefit from the lawsuit’s settlement, there is also a non-monetary benefit. Old Lyme Gourmet company will not be using the "Non-GMO ingredients" label on its products anymore.

The website potatochipssettlement.com also lists certain legal rights. One can exclude themselves by March 25, 2025, and forfeit any monetary payment. However, they can retain the right to pursue their own lawsuit against the Released Parties concerning the claims covered by the Settlement Agreement.

Alternatively, one can object by the same deadline and express their concerns to the Court while remaining bound by the settlement if approved. Individuals under this category may still submit a Claim Form for monetary payment.

If Settlement Class Members fail to submit the claim form within the stipulated deadline, their claim will be rejected, and they will be waived their rights to receive the benefits under the Deep River Potato lawsuit’s settlement.

Only one claim form can be submitted per household, as multiple claim forms from one household will be rejected. The information required in the claim form is as follows:

  • Name
  • Address
  • City
  • State
  • ZIP Code
  • Phone number
  • Number of Deep River potato chips purchased (with and without proof)
  • Payment option
  • Signature
  • Date

The claims must be based on using Deep River potato chips for household purposes, not commercial or resale use. Settlement Class Members must carefully read the claim form before filling it.
