What did Justice Erin Gall say? New York Judge resigns after threatening black teens in viral video

Justice Erin Gall of the New York State Supreme Court has resigned and abandoned her appeal for reinstatement, going against the panel's decision that she be removed from the bench.

The move comes on the heels of a July 2022 incident, where she threatened to shoot some Black kids who crashed a high school graduation party she and her family were at.

As reported by The Law Journal, she even urged the cops to do the same, in addition to taking jibes at their intelligence. She was subsequently suspended with pay. At the time, she told the teens:

“Get off the property! And that’s from Judge Gall! I’m a f__ing judge! Well, you’re going to get in an Uber, buddy, or you’re going to get a cop escort home. That’s how it’s happening. That’s how I roll. That’s how Mrs. G rolls. That’s how Judge Gall rolls.”

Per an official news release from the New York State Commission on Judicial Conduct, Justice Erin Gall went on:

"We didn't invite him. There was trespassing, there were assaults, there was everything. They're saying — they were not invited. There's social media. We didn't invite them. He owns the property. The owner of the property. I'm a judge, he's a lawyer. We're telling you. I'm telling you. This is insane."

Justice Erin Gall abandons her appeal to be reinstated, claiming she doesn't want her family to suffer more

Justice Erin Gall of Oneida County, 53, will no longer appeal to the New York Court of Appeals on January 9, as was initially scheduled.

“I have resigned from my position and have no intention to remain on the bench even if I were to succeed before the Court of Appeals,” the motion read, per The Law Journal, which dates December 15.

The July 2022 incident went on for 80 minutes, during which time she invoked her judicial standing more than a dozen times. Per the official news release from the New York State Commission on Judicial Conduct, she also,

"made disparaging comments about Extreme Risk Protection Orders, which keep guns away from people who are a danger to themselves or others."

Following the incident that August, Gall petitioned the Court of Appeals to take a second look at the commission’s decision in the hopes that she would be granted a less stringent course of action. By December 17, however, her lawyer moved to rescind her application and informed the court that she had resigned.

Reportedly, Justice Erin Gall was a year away from completing her 14-year tenure and agreed to refrain from ever seeking judicial office again. While some of the information remains under wraps, the Law Journal has revealed Gall's motion, in part:

Gall's "story has [been] carried by not only local but national news and social media. The attention incited numerous physical threats upon my family, requiring 24-hour law enforcement protection. In particular, my two sons received numerous death threats. The fear has been immeasurable and terrifying. I do not believe that I can move forward with arguing this appeal for fear that my family will be put in danger once again.”

She also petitioned the Court of Appeals to "help lessen any potential harm to my family due to social media and national news exposure.” She went on, noting that,

"I certainly do not think it fair to characterize my reactions as racially motivated and to stigmatize me with that finding based on the facts in the case."

Justice Erin Gall is a white Republican who has been serving in upstate Oneida County since 2012. Per CBS News, she receives a salary of $232,600 a year.
