A California judge has dismissed a lawsuit against Vanessa Marcil. Marcil's former boyfriend, actor Brian Austin Green, had claimed that Marcil did not repay a loan. Marcil and Green have a son together.
A Los Angeles Superior Court judge last Monday tossed out a lawsuit brought by actor Brian Austin Green against his ex-girlfriend, General Hospital vet Vanessa Marcil (ex-Brenda Barrett).
Green had been seeking repayment for purported unpaid loans totally $200,000. The merits of Green's accusations were not the reason for the case being tossed. Judge Barbara Meiers ruled that the actor's statute of limitations had run out because the former Beverly Hills, 90210 star failed to file the case in time.
Green filed a breach of contract lawsuit in January 2012, alleging that the money he gave to Marcil was a loan and that Marcil never paid him back.
Now, it's Green who may have to pay Marcil. Judge Meiers also ruled that Marcil could seek monetary sanctions from Green to cover her legal and other expenses. Marcil's lawyers, according to E! Online, are seeking in excess of $50,000.
It hasn't been a completely bad week. Green and wife Megan Fox have welcomed a newborn son, Noah Shannon, into their family. Green has another son, Kassius Lijah Green, from his relationship with Marcil.
In August, Marcil filed for divorce from her husband of two years, CSI: NY star Carmine Giovinazzo.
